These terms govern your use of the BeforeYouDraw website and application. By using the service, you agree to these terms. If you don’t agree, please don’t use the service.
BeforeYouDraw is a web-based application that analyzes user-provided portrait photos and produces structural drawing plans. The service is currently provided free of charge during an open beta period. Paid tiers may be introduced in the future, with reasonable notice.
You agree to use BeforeYouDraw only for lawful purposes. You agree not to:
You retain all rights to photos you process through BeforeYouDraw. Because photos are processed entirely in your browser, we never receive a copy and have no claim to them. You also retain rights to drawing plans the service generates from your photos — treat these as derivative works of your input.
For commercial use of the service’s output (selling prints, teaching paid classes using the plans, integrating into commercial workflows), an Atelier-tier subscription is required when paid tiers launch. During the open beta, commercial use is permitted with attribution.
The BeforeYouDraw application, brand, content, methodology, and source code are owned by Tokarz Studio. The name “BeforeYouDraw,” the tagline “See it before you draw it,” the visual brand, and the seven-step method are protected by applicable trademark and copyright law.
You may not use our marks, brand, or methodology in a way that suggests endorsement or affiliation without written permission.
We strive to keep the service available but do not guarantee uptime. The service may be temporarily unavailable for maintenance, updates, or for reasons beyond our control. We are not liable for any losses resulting from service unavailability.
The service is provided “as is” and “as available” without warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that the drawing plans produced will be perfectly accurate for any given photo.
To the maximum extent permitted by law, Tokarz Studio is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the service. Our total liability for any claim related to the service is limited to the amount you have paid us in the twelve months preceding the claim, or USD $100, whichever is greater.
You agree to indemnify and hold Tokarz Studio harmless from any claims, damages, or expenses arising from your use of the service, your violation of these terms, or your violation of any rights of another party.
We may suspend or terminate your access to the service at any time for violation of these terms. You may stop using the service at any time. Termination does not affect any rights or obligations that accrued before termination.
We may update these terms from time to time. Material changes will be communicated through the website or email with reasonable notice. Continued use of the service after changes constitutes acceptance of the new terms.
These terms are governed by the laws of the State of New York, USA, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Monroe County, New York.
